Exemption from appreciation tax for foreign resident

A foreign resident can receive a full exemption from appreciation tax, provided that he does not have another apartment in his country of residence.

In order to receive the exemption, a foreign resident is required to prove through external evidence that he does not own another apartment in his country of residence.

According to the real estate taxation law, a foreign resident must produce a certificate from the tax authorities that he does not have an apartment.

Since a certificate from the tax authorities, at this moment, can only be issued in Russia and Belgium - a resident of these countries is required to produce this certificate.

In countries where such a certificate cannot be issued - non-residents must prove based on objective evidence that they do not own a residential apartment in their country of residence and convince the tax authority of this, in accordance with the guidelines published by the tax authorities.

Purchase tax benefit of a residential apartment for "Olim Hadashim"

There are two routes according to which "Olim Hadashim" can enjoy a purchase tax benefit when purchasing a residential apartment in Israel.

The first one: A discount on purchase tax for a property purchased in Israel in the period between one year before making Aliya and seven years after making Aliya. This discount covers a number of issues, including when purchasing a residential apartment for the Olim's residence. This discount determines the first level of purchase tax at a rate of 0.5%. To be entitled to it, it is not relevant if it is the Ole's sole residential apartment.

The second one: An Ole will be considered a resident of Israel (and not a foreign resident) for the purposes of purchase tax if he was a resident of Israel within two years of the purchase of the apartment. Meaning, if a foreign resident decides to make Aliya within two years of the purchase of the apartment, he will be considered a resident of Israel for purchase tax purposes and will be entitled to benefit from the purchase tax rate of a single apartment (assuming he does not own another apartment in Israel). The first level of the purchase tax for a single apartment is 0%, so many times, if possible, this route will be more profitable for the Ole.
